JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-07-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 365 and 366A of the Indian Penal Code.

As per the prosecution case, on the alleged date and time of the occurrence, all the FIR named accused persons including the petitioner kidnapped minor daughter of the informant in a car.

Learned counsel for the petitioner submits that in fact co-accused Tarun Kumar and victim Khushbu Kumari were in love and she fled away with the said co-accused out of her own sweet will and petitioner has falsely been implicated in this case merely because he is friend of co-accused Tarun

Patna High Court CR. MISC. No.15650 of 2023(3) dt.06-07-2023 2/2 Kumar. Victim in her 164 Cr.P.C. statement has not made any allegation against this petitioner. Petitioner claims clean antecedent.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Muzaffarpur west in Sahebganj Police Station Case No. 128 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
