====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 17-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Majhaulia P. S. Case No.708 of 2020, instituted for the offences under Sections 399, 400, 401, 402, 403, 411, 413, 414, 419, 420, 467, 468, 471, 472, 379, 120B of the Indian Penal Code and Sections 66/ 66(c) of the I. T. Act.

The learned counsel for the petitioner submits that petitioner is in custody since 17.10.2020 and is a person with clean antecedent. Charge-sheet has been submitted in this case. From bare perusal of the F.I.R., it would manifest that the informant has alleged that while the police patrolling was passing by the State Bank of India, Automated Teller Machine when some youth started fleeing away. Patna High Court CR. MISC. No.24170 of 2021(2) dt.17-11-2021 2/2 one of them, who was caught and from whose possession, there is recovery of several ATM Cards and other documents. The petitioner and other accused persons were thus indulged in financial fraud of various account holders.

The learned counsel for the petitioner submits that similarly situated co-accused Samshad Alam @ Shamshad Alam @ Samsad Alam has been granted regular bail vide order dated 22.10.2021 passed in Cr. Misc. No.18072 of 2021 and coaccused Sonu Kumar has been granted bail by another Bench of this Court vide order dated 24.09.2021 passed in Cr. Misc. No.21639 of 2021. The case of present petitioner also stands on similar footing like the aforesaid two accused persons. Considering the facts afore-stated, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Majhaulia P. S. Case No.708 of 2020.

The application stands allowed.
