JUSTICE ARUN KUMAR ORAL ORDER 20-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Phulparas PS Case No. 184 of 2017 registered under Sections 399, 402, 413, 414 of the IPC and Sections 25(1-b)A/26/35 of the Arms Act. The allegation in brief is that the police raided nearby the road side lonely place where number of persons had assembled and said to have recovered one country made pistol from Md. Ishmail and four motorcycles from that place.

Learned Counsel for the petitioner submits that there is no recovery from the possession of this petitioner, he has been made accused in another case subsequent to this case and petitioner is in custody since 9.7.2017.

Having considered the said facts and circumstances, the petitioner, namely, Md. Rahmatullah @ Md. Rahamtula is directed to be released on bail after framing of the charge on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM IInd, Jhanjharpur, Madhubani in connection with Phulparas PS Case No. 184 of 2017.
