1. The instant application has been filed alleging violation of the direction contained in order dated 20.4.2023 (Annexure-1) passed in CWJC no.21326 of 2021.

2. On perusal of the said order it transpires that in view of the fact that the land in question, according to the petitioner's case was a public land, learned counsel for the petitioner had withdrawn the application with liberty to prefer an application under the Bihar Public Land Encroachment Act,

Though the contempt application has been filed alleging violation of the said order dated 20.4.2023, in the opinion of the Court, no contempt is made out as there was no directions contained in the said order and further on query by this Court, it is stated by learned counsel for the petitioner that as per instructions received the petitioner has not even filed any application under the Bihar Public Land Encroachment Act, 1956.

4. The Court finds no merit in the instant contempt application and the same dismissed.
