The petitioner seeks bail in connection with Partatta (Maraiya) P.S. Case No. 11 of 2017 registered for the offence(s) punishable under section(s) 25(1-B) A, 26, 27/35 of the Arms Act. Allegedly three persons were apprehended including the petitioner and from possession of the petitioner, one loaded country made pistol was recovered and for that, the petitioner is in custody since 11.01.2017.

Submission is of false implication and that nothing has been recovered from the possession of the petitioner and now he has remained in custody for six months and as such, he deserves sympathetic consideration.

Patna High Court Cr.Misc. No.29749 of 2017 (2) dt.11-07-2017 2/2 The learned APP fairly submits that the petitioner has remained in custody for about six months.

In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on execution of bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Khagaria in connection with Partatta (Maraiya) P.S. Case No. 11 of 2017, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason, shall disentitle the petitioner from privilege of bail.
