JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 Heard learned counsels for the petitioner and the State. The petitioner being the mother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 302 and 120B/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant after 11-12 years of the marriage. It is alleged that the husband of the victim used to beat the daughter of the informant but when he went to Delhi to earn livelihood then other accused persons used to assault her. The postmortem report reflects the death due to asphyxia caused by hanging.

It is submitted by learned counsel for the petitioner that there is no eye-witness to the occurrence and the thrust of accusation is against the husband of the victim.
