2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 61 (2) and 109 of the BNS and Section 27 of the Arms Act.

3. The case of the prosecution is that the informant's husband Ajay Kumar cutting 'chara' to his cow out side of the house and informant standing on her roof of house. It is further alleged that Anjani Singh, Dabloo Singh, Ashik Kumar, Binni Singh, Pintu Singh came and Anjani Singh having a pistol in his hand gave a gun shot injury on the informant's husband due to which he fell down in the earth. Hence, the FIR.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.13355 of 2025(2) dt.19-03-2025 2/2 connection with the present case. It is further submitted that the main thrust of allegation is against Anjani Singh. Petitioner is only a member of the MOB. Moreover, the petitioner is languishing in judicial custody since 17.10.2024. Further submission is that he is having criminal antecedent of one case in which he is on bail.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Fatuha P.S. Case No. 530 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Patna City.
