2. The petitioner seeks bail in a case registered for the offence punishable under Sections 318(4), 316(2), 338, 336(3) and 340(2) of the B.N.S..
3. The prosecution case, in brief, is that this petitioner, along with co-accused Neetu Devi, came to the informant's house to express their desire to sell a piece of land appertaining to Khata No. 226, Khesra No. 198, Area 14dhur/3.29 dec. and informant paid Rs. 60,000/- as advance and later on, transferred Rs. 9,40,000/- in the account of this petitioner. Thereafter, this petitioner executed the said land in favour of informant on 22.12.2023 and informant demarcated the land. However, when
Patna High Court CR. MISC. No.20645 of 2026(2) dt.01-05-2026 2/3 the informant tried to construct a house over the land in question, co-accused Neetu Devi restrained him saying the land in question has already been transferred by this petitioner in her name.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated in this case with malicious intention. As a matter of fact, after receiving the consideration money, this petitioner has already executed the land in favour of the informant on 22.12.2023 itself and thereafter, the informant came in possession over the land. Moreover, the dispute is with regard to sale and purchase of land, which is purely civil in nature. Charge-sheet has already been submitted and petitioner is in custody since 29.11.2025.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the facts and circumstances of the case, nature of accusation and period of custody, the prayer for grant of bail to the petitioner is allowed.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the
