The petitioner apprehends his arrest in Complaint Case No. 1345 of 2011, registered for the offence punishable under Sections 420, 465, 468, 471 and 120 of the Indian Penal Code.
The allegation is that the petitioner executed a deed of agreement to sell the land of Khata No. 338 of Khesra No. 1067 in favour of the complainant and the petitioner also got a deed of agreement to sell from Charo Uraon. The complainant alleged that the petitioner took Rs. 1,20,000/- for execution of the sale deed from Charo Uraon but later on he came to know that Charo Uraon had already sold the land to one Veena Devi. Learned counsel for the petitioner submits that on

No.4025 of 2015 (2) dt.29-01-2015 perusal of the complaint petition, it would appear that the petitioner got the sale deed executed in his favour from Charo Uraon and Charo Uraon also admitted that he received Rs. 1,20,000/- from the petitioner for execution of the sale deed but since Rs. 50,000/- was lying due and thereafter the complainant paid Rs. 50,000/- and got the sale deed executed. Having considered the fact that the dispute is of civil nature, petitioner Jyotish Ram, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Purnea in connection with Complaint Case No. 1345 of 2011, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
