Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 323, 341, 376/34 of the Indian Penal Code. Allegation is that the accused persons committed rape upon the victim.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.01.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated

Patna High Court CR. MISC. No.13771 of 2019(2) dt.22-04-2019 2/2 in the present case. From the medical examination report, it appears that the victim refused to get medically examined by the doctor. Hence there is no evidence on record. Vide Annexure 2 to the present application, a civil dispute is also pending between the parties. The present case has been instituted for the said reason.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Begusarai in connection with Begusarai Mahila P.S. case No.31 of 2018.
