2. The petitioner seeks regular bail in connection with Sursand P.S. Case No. 453 of 2022 registered on 08.09.2022 lodged under Sections 8/20(b)(ii)(c)/29 of the NDPS Act.

3. As per the prosecution case, F.I.R. has been lodged against sole petitioner to whom there is an allegation of recovery of 20.250 Kg of Ganja.

4. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 09.09.2022 having no criminal case pending against him. The alleged recovery has not been made from the conscious possession of the petitioner rather the same has been made from a motorcycle which does not belong to the petitioner.

5. Learned counsel for the State opposes the prayer for bail and submits that the recovery has been made from petitioner's vehicle and is more than smaller quantity.

6. In the present facts and circumstances of this case, this Court is not inclined to grant bail to the petitioner. Accordingly, the bail application of the petitioner is hereby rejected at present.

7. Trial Court is directed to conclude the trial within nine months from today.
