The petitioner seeks bail in Ekma P.S. Case No.256 of 2017 registered under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
417.600 liters of foreign liquor is said to have been recovered from the poultry farm said to be hailing to the petitioner and petitioner and other accused persons managed to escape. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has been falsely implicated in this case. He does not happen to be owner of the said poultry farm and has no concern with the seized liquor or
Patna High Court Cr.Misc. No.19903 of 2018 (02) dt.11-04-2018 2/ 2 the place of seizure. No case under the Excise Act has been lodged against the petitioner. The petitioner was not apprehended on the spot. He has been languishing in custody since 15.02.2018. Similarly situated co-accused, namely, Krishna Pratap Singh and another have been granted bail by a coordinate Bench of this Court in Cr. Misc. No.16194 of 2018 vide order dated 20.03.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Additional District Judge, Saran at Chapra in connection with Ekma P.S. Case No.256 of 2017.
