JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2019 This application has been filed for cancellation of anticipatory bail granted to the petitioner by the learned 6th Additional Sessions Judge, Bhojpur vide order dated 01.12.2018 passed in A.B.P. No.1852/2018.

Submission of learned counsel for the petitioner is that there is allegation against opposite party no.2 is of kidnapping of minor daughter of the informant, who is still traceless. However, from perusal of the order dated 01.12.2018, the anticipatory bail has been granted to the opposite party no.2 only on the ground that no specific allegation has been attributed against him. So far kidnapping is concerned and the F.I.R. itself shows that the main allegation is against the co-

Patna High Court CR. MISC. No.13605 of 2019(2) dt.07-03-2019 2/2 accused and the opposite party no.2 has assisted the co-accused in kidnapping the victim girl.

Having heard both sides, in view of the facts and circumstances of the case, I do not find any illegality in the impugned order in granting anticipatory bail to opposite party no.2.

Accordingly, this application is dismissed.
