JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 21-05-2015 Heard learned senior counsel for the petitioner and learned Additional Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 15, 18, 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act at the instance of the Sub-Inspector of Police, Bariarpur Police Station.

It is alleged that the Police received a secret information that the petitioner was engaged in producing opium in the field of one Md. Jamal.

Learned counsel for the petitioner appears to be right in his submission that except the allegation of secret information that petitioner was involved in production of opium in the said

Patna High Court Cr.Misc. No.3208 of 2015 (3) dt.21-05-2015 2/2 field, there is no material to connect the petitioner with the offence alleged.

In view of the submission as above, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Munger in connection with Bariarpur P.S. Case No. 46 of 2014, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
