2. Counsel for the petitioners submits that the present writ petition has been filed for setting aside the order dated 23.08.2022 passed by Circle Officer, Sahar in Measurement Case No.40 of 2022-23.

3. Counsel for the State raised a preliminary objection that there is a provision of appeal against the order in the measurement case, under Section 23 (3) of the Bihar Tenancy Rule of the Bihar Tenancy Act, 1885 [Act VIII of 1885].

4. In this view of the matter, petitioners are directed to avail the remedy of appeal as laid down under Section 23 (3) of the Bihar Tenancy Rule of the Bihar Tenancy Act, 1885 [Act VIII of 1885].

5. The petitioners shall file the said appeal within 4

Patna High Court CWJC No.4822 of 2023(3) dt.18-09-2023 2/2 weeks from today and the Appellate Authority is directed to take necessary action within 60 days thereafter.
