This is an application for bail in connection with Barachatti P.S. Case No. 193 of 2000 registered for the offences punishable under Sections 396 of the Indian Penal Code and 17 of CLA Act.

Petitioner is not named in the FIR and later on his name transpires during course of investigation and the case relates to murder of wife of the then Deputy Commissioner. Submission of learned counsel for the petitioner is that he has no knowledge about the case, as such, he could not appear earlier in this case and all the co-accused persons have been granted bail and he is in custody since 5.12.2016. Heard learned APP also, who has opposed the prayer for

Patna High Court Cr.Misc. No.29872 of 2017 (5) dt.14-09-2017 2/2 bail stating that charge sheet has been submitted in 2005 and he has been arrested on 5.12.2016, as such, he was absconding. Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner. However, as petitioner is in custody for nine months, learned trial court is directed to expedite the trial and try to conclude it as soon as possible, preferably within a period of one year.
