The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307 and 34 of the Indian Penal Code.
Specific accusation of causing injury on the head of the informant by musar is against Samsuddin Miyan (nonpetitioner). When the uncle and grand-father of the informant came to rescue the informant, the accused persons assaulted them.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.3879 of 2015 (2) dt.29-01-2015 petitioners that accusation has been levelled in the background of series of land dispute. The accusation levelled against the petitioners is general and omnibus in nature. The injuries of three injured persons have been found to be superficial and simple in nature.
Considering the aforesaid facts and the statement made in para-3 of the petition that the petitioners have no criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran in connection with Marhowrah P.S. Case No. 343 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
