The petitioner apprehends his arrest in connection with Sabour (Goradih) P.S. Case No.278 of 2018 registered under Section 376 of the Indian Penal Code besides Sections 3⁄4 of the POSCO Act, pending in the court of the Additional Sessions Judge-I, Bhagalpur.

The accusation is of entering the petitioner at the house of the informant and committing rape on her, giving allurement to perform the marriage.

Having considered the facts and the circumstances of the case and the nature of allegation, I am not inclined to grant the privilege of pre-arrest bail to the petitioner. Accordingly, the

Patna High Court CR. MISC. No.13432 of 2019(4) dt.18-06-2019 2/2 prayer of the petitioner for grant of privilege of pre-arrest bail stands rejected. However, the petitioner is directed to surrender before the trial court and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
