Petitioner seeks regular bail in Bochahan P.S. Case No.205 of 2017 instituted for the offence under Sections 376 and 379 of the I.P.C., Allegation against the petitioner is of committing rape on the informant in the night of 29.09.2017 while she was sleeping and also snatching silver chain and cash and thereafter threatening her of dire consequences in case of disclosing it to any one. The victim was examined by the Medical Board and according to the Medical Board no sign of any injury or rape is found on the body of the informant.

It has been submitted by the petitioner that no

Patna High Court Cr.Misc. No.3085 of 2018 (3) dt.12-02-2018 2/2 spermatozoa was found in Medical report.

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the A.C.J.M., -cum-Sub Judge 11th, Muzaffarpur, in Bochahan P.S.Case No.205 of 2017.
