JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 354 and 379/34 of the Indian Penal Code.
It is alleged that the accused persons pressed the mouth of the informant and assaulted her and when the son of the informant started crying, he was also assaulted, thereafter, the husband of the informant came to rescue then he was being assaulted and the earring of the informant was snatched. It is submitted by learned counsel for the petitioner that for the occurrence of 06.06.2014 at 8 PM, the FIR was lodged on 07.06.2014 at 1.15 PM but the FIR was transmitted to the InCharge CJM after three days on 10.06.2014 and there is counter version of the occurrence also.
