The petitioner seeks bail in connection with Brahmpura P.S. Case No. 388 of 2019 registered for the offences punishable under Sections 399, 402, 120B/34 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.
The prosecution case as alleged in the F.I.R. is that S.H.O. Brahampura P.S. recorded his self statement on 12.11.2019 at 9.30 P.M. stating therein that the raiding party was on Gasti at Laxmi Chowk in the meantime, he got information that 4-5 persons were indulged in preparation for committing crime near Tanduri Hotel. When the raiding party reached there, having seeing them, the culprits tried to fled away but they were apprehended. On question, they disclosed their name Hemant

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. He further submits that similarly situated coaccused has been granted bail by this Co-ordinate Bench of this Court passed in Cr. Misc. No.11469 of 2020 and Cr. Misc. No.12517 of 2020 and petitioner is in jail custody since 13.11.2019.
Learned A.P.P. for the State has opposed the prayer. In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of C.J.M., Muzaffarpur in connection with Brahmpura P.S. Case No.388 of 2019.
