The petitioner seeks bail in connection with Kochas P.S. Case No. 170 of 2016 registered for the offences punishable under Sections 8 (c ), 20 (B), 22 and 27 (A) of the Narcotic Drugs & Psychotropic Substances Act.
Allegedly, from the house of the petitioner 7 kilogram Ganja was recovered and the petitioner disclosed that his brother Santosh Sah used to sale the Ganja in Gumti.
Submission is of false implication and that the petitioner has been made victim of circumstances, nothing has been recovered from conscious possession of the petitioner, without any fault he is suffering in custody since 10.12.2016, he is involved in one more case i.e. Kochas P.S. Case No. 169 of 2016 and except that he has got no criminal antecedent and as such he deserves
Patna High Court Cr.Misc. No.29898 of 2017 (2) dt.12-07-2017 sympathetic consideration.
Learned APP opposes the prayer of bail by pointing out the alleged recovery.
In the facts and circumstances stated above, considering the alleged recovery, at present, this Court is not inclined to enlarge the petitioner on bail, accordingly, his such prayer stands rejected.
