ANJANA MISHRA ORAL ORDER 17-02-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 01.06.2017 in connection with Jandaha P.S. Case No.36 of 2017 registered for the offence under Sections 302, 201 and 120B/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that there is no specific allegation against the present petitioner. Learned counsel for the petitioner further submits that there is no iota of evidence to connect the petitioner with the present case and the diary also does not support the allegation.
Learned counsel for the State after perusal of the case diary submits that at paragraph 53, the specific allegation is
Patna High Court Cr.Misc. No.3625 of 2018 (3) dt.17-02-2018 2/2 against Ram Kumar Chaudhary and not against the present petitioner.
In view of the aforementioned facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateXI, Vaishali at Hajipur, in connection with Jandaha P.S. Case No.36 of 2017.
