The petitioners apprehend their arrest in a case under Section 307 and other sections of the Indian Penal Code. The informant made allegation that Dharmendra Dhangar assaulted him with iron rod and all other accused persons including the petitioners assaulted Dhuran Ram. It is submitted that there is no specific allegation of assault against the petitioners but, on perusal of the case diary, it appears that Dhuran Ram received as many as five injuries. The opinion with regard to injury no. 2, 3 & 4 was kept reserved and the patient was referred to M.J.K. Hospital, Bettiah for treatment and thereafter he was referred to PMCH, Patna for better treatment.

No.11831 of 2016 (4) dt.23-06-2016 2/2 Considering the facts aforesaid and the fact that the petitioners assaulted Dhuran Ram and as many as five injuries were inflicted upon him, I am not inclined to enlarge the petitioners on anticipatory bail in Chanpatia P.S. Case No. 171 of 2015. Accordingly, the same is rejected.

If the petitioners surrender in the court below, the court below shall consider the prayer for regular bail of the petitioners taking into consideration that a co-accused Dhuran Ram has already been enlarged on regular bail. (Prabhat Kumar Jha, J) Dilip/- U T
