JUSTICE ARUN KUMAR ORAL ORDER 27-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 04.01.2018 seeks bail in connection with Nasriganj P.S.Case No. 74 of 2014 registered under Sections 364 and 120B/34 of the Indian penal Code.

Allegation in brief is that FIR named accused persons taken away the informant's husband for operation of his eye and thereafter he is traceless.

Submission is that petitioner is not named in the FIR and only material transpires against him that he was attending the informant's husband in a private clinic and Sankala Devi, FIR named accused, who had taken him for treatment and incurred all expenditure relating to operation, has been admitted to anticipatory bail by a co-ordinate Bench of this Court vide order

Patna High Court Cr.Misc. No.17646 of 2018 (2) dt.27-03-2018 2/2 dated 23.02.2016 passed in Cr. Misc. No. 5162 of 2016. it is further submitted that petitioner was servant of the informant and has no criminal antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Dinanath Ram, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bikramganj, Rohtas, in connection with Nasriganj P.S. Case No. 74 of 2014.
