The petitioner seeks bail in G. B. Nagar P.S. Case No. 348 of 2017 registered under Sections 272, 273 and 308 of the Indian Penal Code and Sections 30, 34, 36 and 41 of the Bihar Prohibition and Excise Act, 2016.

04 litres of country made liquor, 2 Kg jaggery and 200 gm Naushadar are said to have been recovered from the tiled house of the petitioner.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He was not apprehended on the spot. He has no concern with the seized liquor.

He has been languishing in custody since 25.01.2018. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-2nd Siwan cum Special Judge, Bihar Prohibition and Excise, Siwan in G.B. Nagar P.S. Case No. 348 of 2017. (Prakash Chandra Jaiswal, J) Mishra/- U T
