The petitioner seeks bail in connection with Excise Complaint No.618 of 2017 registered under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that in course of raid, one Bolero vehicle was stopped in which four persons were found sitting, who disclosed their name as Dabloo Kumar, Pintu Kumar, Awadh Patel and Sanjay Kumar (petitioner). On search of the vehicle, 1000 pouches, each containing 200 ml. country made liquor, were recovered.

Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.7782 of 2018 (2) dt.08-02-2018 2/2 submits that, in fact, the vehicle was being driven by Pintu Kumar and the petitioner was only sitting in the vehicle. The petitioner has no concern with the seized liquor and he having no criminal antecedent is in custody since 16.11.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Banka, in connection with Excise Complaint No.618 of 2017.
