The petitioner seeks bail in connection with Jagdishpur P.S. Case No. 275 of 2015, registered for the offences punishable under Section 394 of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected vide order dated 06.12.2016, passed in Cr. Misc. No. 42380 of 2016.

Learned counsel for the petitioner submits that the petitioner is in jail since 19.02.2016. The petitioner has already remained in jail for about nineteen months but the trial has not been concluded. Similarly situated co-accused namely Ranjit Singh @ Pintoo Singh has already been enlarged on bail vide

Patna High Court Cr.Misc. No.33708 of 2017 (3) dt.13-09-2017 2/2 order dated 08.04.2016, passed in Cr. Misc. No. 14601 of 2016. The case of the petitioner stands on different footing as petitioner has been duly identified by the informant.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected. However, the learned lower court is directed to conclude the trial as expeditiously as possible preferably within six months from the date of receipt/production of a copy of this order.
