02-02-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner, in the present case, is seeking regular bail in connection with Laheri P.S. Case No. 486/2017 registered for the offence punishable under Sections 25(1-b)a 26, 35 of the Arms Act.
Learned counsel for the petitioner submits that the name of this petitioner has transpired on the confessional statement of the co-accused who was arrested by police. Nothing has been recovered from the possession of this petitioner. Learned counsel further submits that the petitioner has been involved in one case of Excise Act in which he is on bail.

Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Laheri P.S. Case No. 486/2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure with further condition that if he is found involved in similar offence, the Investigating Officer of this case will have liberty to move before the court below for cancellation of bail bond of the petitioner.
