02. 13.07.2017 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Sections 30(a), 38 and 47 of the Prohibition of Bihar Excise (Amendment) Act, 2016.
It is contended that, as per allegation, 300 litres of country-made liquor were recovered from the vehicle which was being boarded by two persons including the petitioner who was the driver. Petitioner claims that he is having clean antecedent and is in custody since 14.05.2017. Having regard to the facts and the circumstances of
Patna High Court Cr.Misc. No.31867 of 2017 (2) dt.13-07-2017 the case, the petitioner, above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Gaya in connection with Barachati P.S. Case No. 232 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
