Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Petitioner is in custody since 26.07.2016 in the matter of an FIR registered against unknown for the offence of robbery.
Submission is that nothing was recovered from possession of the petitioner nor the petitioner was ever put on TI Parade. The investigation is complete now and the petitioner is ready to cooperate with the trial. Only material is confessional statement of co-accused, namely, Pintu Rai and some criminal antecedent against the petitioner.
Considering the aforesaid facts, especially, the
Patna High Court Cr.Misc. No.11432 of 2018 (2) dt.28-02-2018 2/2 period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sono Police Station Case No. 170 of 2014, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
