1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Learned counsel for the petitioner submits that the present application has been filed seeking cancellation of the anticipatory bail granted to the opposite party no. 2 by the Court of learned 1st Additional District and Sessions Judge, Patna in Phulwari Sharif P.S. Case No. 1140 of 2023.

3. Mr. Rabindra Kumar learned A.P.P. vehemently opposes the cancellation application and submits that the petitioner ought to have moved before the Court of learned 1st Additional District and Sessions Judge, Patna for seeking cancellation of anticipatory bail granted to the opposite party no. 2 if she was aggrieved by the said fact.

4. At this stage, learned counsel for the petitioner seeks permission to withdraw the cancellation application with liberty to move before the appropriate Court.

5. Permission is accorded.
