JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 21.01.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.

Petitioners apprehend their arrest in connection with Mirganj P. S. case no. 220/2014 registered under sections 376, 511, 354B, 323, 504/34 of the IPC.

Taking into consideration that allegation of attempt to rape and outrage modesty of the informant has been levelled against petitioner no.1, namely, Sachindra Kumar, I am not inclined grant privilege of anticipatory bail to petitioner no.1 and accordingly, his prayer for anticipatory bail in connection with Mirganj P. S. case no. 220/2014 stands rejected.

So far as rest petitioners are concerned, no allegation of outraging the modesty of the informant has been levelled against them.

Accordingly, this anticipatory bail petition is allowed in respect of petitioner nos. 2 to 4 and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this

No.2839 of 2015 (2) dt.21-01-2015 order to the concerned court, let the petitioner nos. 2 to 4, namely, Jitendra Kumar, Surendra Kumar and Nathuni Kharwar @ Nathuni Prasad be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in Mirganj P. S. case no. 220/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
