The petitioner is apprehending his arrest in connection with Runnisaidpur P.S. Case No. 307 of 2014 for the offences instituted under Section 306 of the Indian Penal Code. It is alleged in the fardbeyan that Julaisha Khatoon who was living with petitioner, has committed suicide. Petitioner has illicit relationship with Julaisha Khatoon, on account of which she became pregnant. Julaisha Khatoon was requesting the petitioner to marry her but he did not become ready. Thereafter, on account of shock and defamation in the society, she committed suicide by hanging herself.
Patna High Court Cr.Misc. No.11288 of 2016 (2) dt.25-04-2016 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. As per the allegation, due to illicit relationship between the petitioner and the deceased, she has committed suicide. Petitioner is the Jija of the deceased. A petition has been filed in the court below vide Annexure-2 to the present petition, where the father of the deceased has stated that there was no such illicit relationship between the petitioner and the deceased. The deceased had died due to natural death. The case has been instituted by the Chaukidar due to village politics. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Runnisaidpur P.S. Case No. 307 of 2014/G.R.No.2815 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Sitamarhi, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
