The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 376, 511, 354 and 506/34 of the Indian Penal Code and Sections 4 of the POCSO Act.
As per First Information Report, while informant was working as domestic help in an adjacent home, her son, Imran Khan came and informed her that one co-accused, namely, Tunna Khan barged in the house of informant and tried to outrage the modesty of her daughter and as soon as she reached there, the miscreants fled away.
Patna High Court CR. MISC. No.14239 of 2022(2) dt.06-09-2022 2/2 It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that the main allegation of attempt to commit rape and outraging the modesty of the daughter of the informant is attributed to co-accused, Tunna Khan. There is general and omnibus allegation against the present petitioners of giving threatening etc.
Learned APP appearing for the State opposed the anticipatory bail.
Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned VII Additional Sessions Judge-cum-Special Judge, POCSO, West Champaran, Bettiah in connection with Ramnagar P.S. Case No. 448 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
