Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek regular bail in connection with Roh PS case no. 177 of 2024 dated 18.06.2024 instituted for the offences punishable under Sections 419, 420, 467, 468, 471, 120(B)/34 of the Indian Penal Code and Sections 66(C),
Patna High Court CR. MISC. No.12257 of 2025(2) dt.21-02-2025 2/3 66(D) of the Information Technology Act.

The case of the prosecution, as per the allegation made in the F.I.R, is that on 17.06.2024 in the evening, police got secret information that petitioners were scamming/ decoying people on phone by false assurance of jobs, reached at the place of occurrence. On seeing the police party, they started fleeing away, however one person namely Pawan Kumar was apprehended and others succeeded in fleeing away. Upon inquiry, the arrested co-accused disclosed the name of the petitioners and others.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case on the disclosure of their name by the arrested co-accused. The co-accused Pawan Kumar who was arrested on the spot has been granted regular bail by this Court vide order dated 18.10.2024, passed in Cr. Misc. No. 59215 of 2024. He further submits that during investigation, no cogent material has come against the petitioners in order to connect them with the present case. The petitioners are not having criminal antecedent of similar nature of offence and they are in custody since 26.10.2024 and 19.11.2024 respectively. He also submits that charge-sheet has already been submitted and

Regard being had to the submissions made on behalf of the parties and taking into consideration the fact that petitioners are in custody since 26.10.2024 and 19.11.2024 respectively, charge-sheet has already been submitted and similarly situated co-accused person who was arrested on the spot, has been granted bail by this Court, I deem it fit and appropriate to admit the petitioners to the privilege of bail. 6.
Accordingly, the abovenamed petitioners are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of learned court of Chief Judicial Magistrate, Nawada in connection with Roh PS case no. 177 of 2024.
