JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-08-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 363, 365, 34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with other accused persons kidnapped the daughter of informant. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The victim in her statement u/s 164 of the Cr.P.C. denied the prosecution case and specifically stated that she voluntarily left her house and went to her uncle's house at Ludhiana and no one kidnapped her. The doctor has assessed her age to be 18-20 years. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the

Patna High Court CR. MISC. No.14046 of 2022(3) dt.23-08-2022 2/2 prayer for anticipatory bail.

Considering the facts of the case and the statement of victim recorded u/s 164 of the Cr. P. C., let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI, Katihar in connection with Mansahi PS case No. 33/ 2021, subject to conditions laid down u/s 438(2) of the Cr.P.C.
