JUSTICE SHIVAJI PANDEY ORAL ORDER 04-09-2020 Heard learned counsel for the petitioners and learned counsel for the State through Video Conferencing. In this case, the petitioners are seeking anticipatory bail in connection with Garkha P.S. Case No. 755 of 2019 registered for offence punishable under sections 341, 323, 324, 325, 307, 504/34 of the Indian Penal Code.

Allegation has been made against the petitioner no. 1 to have assaulted the victim by iron road and petitioner no. 2 by sword.

Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioners and accordingly their prayer for bail is rejected. However, if the

Patna High Court CR. MISC. No.12369 of 2020(3) dt.04-09-2020 2/2 petitioners surrender before the court below and pray for regular bail, the court below without being prejudiced by this order will take decision in accordance with law.
