Petitioners, already in custody, seek bail in connection with Gaunaha P.S. Case No.111 of 2017, registered under Sections 147, 148, 149, 341, 323, 324, 325, 332, 333, 307, 436, 395, 427, 353, 151, 152, 153, 187, 188, 189 and 120B of the Indian Penal Code as well as under Section 27 of the Arms Act. Allegation in brief is that a large number of villagers ransacked the police station on account of inaction by the police in connection with a murder.
Learned counsel for the petitioners submits that almost all villagers have been made accused in this case including male
Patna High Court Cr.Misc. No.10967 of 2018(2) dt.27-02-2018 2/2 and female. There is no specific allegation against the petitioners and other co-accused similarly situated have been admitted to bail by a coordinate Bench of this Court by by order dated 19.02.2018, passed in Cr. Misc. No.9756 of 2018 and order dated 22.02.2018, passed in Cr. Misc. No.10427 of 2018. Having considered the said facts and circumstances, petitioners, namely, Niranjan Panjiyar @ Niranjan Prasad, Jitendra Mahato @ Jitendra Prasad and Brijesh Mukhiya are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Bettiah, West Champaran in connection with Gaunaha P.S. Case No.111 of 2017.
