2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Majorganj P.S. Case no. 211 of 2023 instituted for the offence under Sections 505, 506 of the Indian Penal Code, Sections 25(a), 7 27(3) of the Arms Act and Section 66 of the I.T. Act.

3. As per prosecution case, it is alleged that a photo was going viral over the Facebook in which co-accused was seen riding motorcycle and having pistol in his hand causing intimidation to local people. It is further alleged that this petitioner also involved in this crime.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

He has no concern with the alleged occurrence. Similarly situated other co-accused person has already been granted bail by this Court vide order dated 15.01.2024 in Cr. Misc. No. 75120 of 2023.

5. Learned APP appearing for the state has opposed the prayer of bail of the petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Majorganj P.S. Case no. 211 of 2023 he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Sitamarhi subject to the conditions as laid down under section 438(2) of the Cr.P.C.
