The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 365, 366A, 504 and 506/34 of the Indian Penal Code. The prosecution case is of abducting the minor daughter of the informant.
It is submitted by learned counsel for the petitioners that though the victim in her 164 Cr.P.C. statement got her age recorded as 19 years when the court has assessed 1516 years where she has stated that she of her own left the house
Patna High Court Cr.Misc. No.10800 of 2016 (2) dt.14-03-2016 2/2 and went in the company of Bikram with whom she married. The victim has not named these petitioners. It is further submitted that since the petitioners are parents of main accused Bikram, hence, they have been roped in the present case. Considering the fact that the petitioners are not named by the victim in 164 Cr.P.C. statement, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Turkauliya P.S. Case No. 743 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
