The petitioner seeks bail in a case registered for the offences punishable under Sections 30, 30(a) and 41 of the Bihar Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 24.01.2022, charge-sheet has been submitted in the case and has antecedent of one case. Allegation is of recovery of 174 litres of liquor from an auto owned by one Rohit Kumar Singh.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, neither he is the owner nor the driver of the said auto, nor he was arrested from the spot.
Patna High Court CR. MISC. No.14099 of 2022(2) dt.26-05-2022 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 24.01.2022, charge-sheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mashrakh P.S. Case No. 572 of 2021.
