The petitioner seeks regular bail in connection with Kotwali (Barari) P.S. Case No. 637 of 2017, registered for the offence punishable under Sections 395 of the Indian Penal Code. The allegation, according to the F.I.R., is that certain unknown accused persons had come to the house of the informant and intimidated him with pistol as well as tied him and thereafter they had taken away the battery from his shop. Learned counsel for the petitioner submits that the FIR is against unknown persons, the petitioner is in custody since 13.01.2017 and similarly situated other accused persons have been granted bail by this Court on 09.03.2017 in Cr. Misc. No. 9010 of 2017.

Having regard to the facts and circumstances of the

Patna High Court Cr.Misc. No.28999 of 2017 (2) dt.01-07-2017 2/2 case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Barari) P.S.
