The petitioner seeks regular bail in connection with Katihar Nagar Police Station Case No. 361 of 2020, for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

The allegation is recovery of 124 litres of foreign liquor and 63 litres of country made liquor from a room of the lodge.

Learned counsel for the petitioner submits that the petitioner was employe of the lodge where illicit liquor were seied but he has no concern with the seized liquor. He is not

Patna High Court CR. MISC. No.15541 of 2023(3) dt.12-04-2023 2/2 involved in illegal trade or smuggling of liquor which is prohibited. No progress has taken place in conduct of trial. Considering the fact that the petitioner is habitual offender, it would be not in the interest of the society to enlarge the petitioner on bail. Therefore, the prayer for bail stands rejected.

However, the trial Court is directed to conclude the trial expeditiously. In case the prosecution witnesses do not turn up on the date fixed for conduct of trial, the Court below is required to inform the Superintendent of Police concerned, who will ensure production of all the prosecution witnesses within a period of three months.

With the above observation, the present bail application stands disposed of.
