The petitioner seeks regular bail in connection with Narpatganj P.S. Case No. 13 of 2017 dated 11.01.2017, registered for the offence punishable under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code.
The accusation is that when the informant was constructing a house, the accused petitioner and others came there armed with lathi, farsa, sword and started quarrelling with the informant. It is further alleged that when the protest was made by the informant, the said accused persons had brutally assaulted the informant.
Learned counsel for the petitioner submits that the petitioner has clean antecedent and he is in custody since
Patna High Court Cr.Misc. No.28977 of 2017 (2) dt.01-07-2017 2/2 01.05.2017 and similarly situated accused persons have been granted bail by this Court by order dated 25.04.2017 passed in Cr. Misc. No. 15814 of 2017.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Narpatganj P.S.
