JUSTICE ARUN KUMAR ORAL ORDER 25-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Gogri PS Case No. 479 of 2017 registered under Sections 30(A), 41(1) of the Bihar Prohibition and Excise Act and under Section 25(1-B)A of the Arms Act.

The allegation in brief is that the police recovered country made liquor and three bottles of foreign liquor from the house of coaccused Ravindra Kumar and the petitioner was also found present there.

Learned Counsel for the petitioner submits that the petitioner had gone in connection with taking money as he had sold mobile to Ravindra Singh and the recovery is not from his possession or his house. The petitioner is in custody since 11.11.2017 and he has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Prince Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, lst, Khagaria in connection with Gogri PS Case No. 479 of 2017.
