JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner seeks bail in connection with Barahara P.S. Case No.326 of 2019 registered under Sections 25(1-B) A and 26 of the Arms Act.

The accusation is that on receiving the secret information about the presence of Karan Singh alias Ghural Singh (petitioner) at his house in village-Akwana, wanted in Barhara P.S. Case No.295 of 2019, the informant along with other police personnel reached there. On seeing the police party, one person started to flee way from there but, on chase, he was apprehended, who disclosed his name as Karan Singh alias Ghural Singh (petitioner). On search, he was found in possession of one loaded country made pistol and one live cartridge.

No.11878 of 2020(4) dt.30-06-2020 2/2 Learned counsel appearing on behalf of the petitioner submits that the petitioner, in the present case, is in custody since 16.09.2019. It is submitted by the learned counsel for the petitioner at the Bar that after being apprehended in the present case, the petitioner was remanded in Barhara P.S. Case No.295 of 2019 but he was allowed the privilege of bail in that case by the court below. It is also submitted by him at the Bar that the petitioner is also accused in Barhara P.S. Case No.121 of 2018 but in that case, he is also on bail. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, in connection with Barhara P.S. Case No.326 of 2019. Out of the two sureties, one must be either parents or the close relative of the petitioner. (Rajendra Kumar Mishra, J) P.S./- U T
