The petitioners apprehend their arrest in Complaint Case No. 1406C of 2013, registered for the offences punishable under Section 468 and other Sections of the Indian Penal Code. Bheem Yadav alleged that he purchased a piece of land from the petitioners but when he went on the land Ram Das Mahto disclosed that he had already purchased the same piece of land from one Bachchi Singh.

Learned counsel for the petitioners submits that Ram Das Mahto did not show any sale deed. The petitioners never

Patna High Court Cr.Misc. No.3707 of 2015 (2) dt.28-01-2015 executed any sale deed in favour of Ram Das Mahto and the petitioners are still ready to repay the amount of consideration, if the sale deed is found to be forged.

Having considered the facts aforesaid and the fact that the dispute appears to be of civil nature and the petitioners are still ready to refund all the money, if the sale deed executed by them is found to be forged, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Rajesh Kumar Dwivedi, the learned Judicial Magistrate Ist Class, Begusarai in connection with Complaint Case No. 1406C of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
