JUSTICE SUDHIR SINGH ORAL ORDER 10-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 498(A), 341, 323, 504 of the I.P.C. and 37(b) of the Bihar Prohibition and Excise Act, 2016. Allegation is that the petitioner always came to her house in drunken state and assaulted the informant. Three empty bottles of liquor was produced by the informant to the police. It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.3.2017 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that three empty bottles of liquor is said to have been recovered. It is further
Patna High Court Cr.Misc. No.31379 of 2017 (2) dt.10-07-2017 2/2 submitted on behalf of the petitioner that the informant is residing with her in-laws. Due to petty reason the present case has been instituted. The said fact has been admitted by the counsel for the informant.
On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Pupari, Sitamarhi in connection with Sursand P.S. case No.85 of 2017.
