The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 323, 324, 307 and 504 of the Indian Penal Code.
It is alleged that the petitioners assaulted the informant and his family members. It is specifically alleged against Kapil Paswan to have assaulted on the head of the informant with Garasa. Injury report of the informant has been brought on record by way of supplementary affidavit which reflects only one lacerated wound in the forehead and rest injuries have been found to be pain and swelling. There is counter version of occurrence also. A statement has been made in paragraph no. 3
Patna High Court Cr.Misc. No.4410 of 2015 (2) dt.23-02-2015 2 / 2 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the petitioners, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Chandauti P.S. Case No. 190 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Gaya, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
